DRAFT, not legal advice. This is a plain-English template. Review it (ideally with a solicitor) before launch and before taking payments.

Terms of use

1. About us

CheckFair is a trading name of Ian McClelland, a sole trader in the UK ("we", "us"). Contact: see contact page. Address: [TODO: business postal address].

2. Using this website now

CheckFair has not launched. Right now you can read about the service, view a sample report that uses made-up data, and join a waitlist. No checks are sold and no payments are taken.

3. What a CheckFair report is

A report is a point-in-time summary of information held by third-party registers and official sources about a vehicle on the date you request it. Vehicle data comes from registers and third parties at the time of the request. It may be incomplete or out of date, is not a substitute for a physical inspection or professional advice, and must not be the sole basis for a decision to buy, sell, finance or insure a vehicle.

The fair-price check is a guide based on typical values. It is not a formal valuation and not financial advice.

4. Acceptable use

  • Use CheckFair only to check a vehicle you're genuinely thinking of buying (or already own).
  • Don't use a report to trace, identify or contact a current or previous keeper.
  • Don't copy, resell, share publicly, bulk-request or build a database from reports.
  • Don't try to break, overload or scrape the site.

5. Buying a check (when available)

Prices will be shown before you pay, in pounds, including any tax. Because a report is digital content delivered immediately, you'll be asked to agree that it is supplied straight away and that you then lose your 14-day right to cancel. If a check fails or the vehicle can't be found, we'll refund you. [TODO: final refund policy before launch]

6. Our responsibility to you

We'll provide the service with reasonable care and skill. We are not responsible for errors in third-party data we couldn't reasonably have known about, or for decisions made solely on a report. Nothing in these terms limits your statutory rights as a consumer, or our liability for death or personal injury caused by negligence, or for fraud. [TODO: liability cap wording to be reviewed]

7. Independence

CheckFair is an independent service and is not affiliated with or endorsed by HPI, Experian, the DVLA or the DVSA. MOT data contains public sector information licensed under the Open Government Licence v3.0.

8. Complaints and law

If something goes wrong, email us first and we'll try to put it right. These terms are governed by the law of England and Wales [TODO: confirm jurisdiction, e.g. Northern Ireland or Scotland if Ian is based there], and you can bring a claim in the courts of the UK nation where you live.
